Welcome to August Online. Please read the following Terms of Service carefully before utilising our website, social platforms, or client concierge features. By accessing or shopping on our platform, you unconditionally agree to comply with and be bound by these terms. We reserve the right to update these terms at our sole discretion. Continued use of the platform following any modifications constitutes your acceptance of the updated terms.
1. Platform Ownership & Intended Use
These terms apply to all digital properties owned, hosted, or operated by August Online, including our boutique framework, archival indexes, and official social media extensions (collectively, the “Sites”).
Unless explicitly permitted by our team in writing, you may access and view the materials on our Sites strictly for personal, non-commercial use.
2. Intellectual Property & Brand Protection
August Online curates highly exclusive, often single-edition archival fashion items.
- All creative components on our platform—including editorial photography, styling, brand graphics, unique item descriptions, website code, and layout architecture—are the exclusive intellectual property of August Online.
- You may not alter, copy, scrape, reproduce, republish, distribute, or commercially exploit any material, imagery, or trademark from our platform without our prior express written authorisation. Unauthorised usage will result in immediate legal action to protect our archival rights.
3. Inventory, Pricing, & Order Acceptance
Because our archive primarily consists of rare, preloved, and one-off luxury items, unique operational rules apply to checkouts:
- Single-Edition Availability: Items are sold on a first-come, first-served basis. Placing an item in your shopping cart does not reserve it. An item is only secured once checkout is entirely complete.
- System Glitches & Overselling: In the highly exceptional event that a technological synchronisation error allows two clients to purchase the same one-off item simultaneously, August Online reserves the right to cancel the secondary order and issue a prompt 100% refund.
- Pricing Accuracy: While we strive for perfection, if an item is accidentally listed at an incorrect price due to a typographical or systemic error, we reserve the right to decline or cancel any orders placed for that item and provide a full refund.
4. Third-Party Links & Networks
Our platform may feature integrations or links to external corporate networks (such as payment processors, shipping API aggregators, or external content platforms). We do not create, maintain, or endorse the independent operations of these third-party organisations. Under no circumstances will August Online be held liable, directly or indirectly, for any logistical friction, loss, or damage caused by your interaction with external third-party plug-ins or external domains.
5. Disclaimers & New Zealand Consumer Law
August Online proudly stands behind the curation and execution of our platform.
⚖️ Statutory Consumer Rights Notice: Nothing within these Terms of Service is intended to avoid, limit, or contract out of your statutory consumer rights under the New Zealand Consumer Guarantees Act 1993 or the Fair Trading Act 1986.
- Digital Platform Disclaimer: While we maintain premium, high-encryption hosting networks, we provide our digital storefront interface on a stable "as available" operational baseline. We do not warrant that digital site access will be entirely uninterrupted, completely error-free, or that our host servers are entirely free of external digital anomalies or viruses.
- Product Condition: As detailed in our Archive Descriptions, items are pre-owned unless explicitly stated otherwise. We guarantee the structural accuracy of our descriptions under New Zealand law, but natural vintage characteristics do not constitute product defects.
6. Limitation of Liability
To the maximum extent permitted under New Zealand commercial law, August Online, its directors, and technical infrastructure suppliers will not be held liable for any incidental, indirect, or consequential digital damages (including but not limited to network device downtime or data drops) arising out of your navigation of the platform. In any event, our total liability to you for any verified direct losses or causes of action regarding a commercial transaction will be strictly capped at the exact purchase price paid by you for the specific physical item in question.
7. Governing Law
These Terms of Service, along with your access to our boutique framework, are governed completely by the laws of New Zealand. Any structural disputes, legal filings, or operational grievances that cannot be resolved amicably through our Concierge Desk will fall under the exclusive jurisdiction of the Courts of New Zealand.
